These terms and conditions govern the use of Swift Recruitment Agency UK's services by both clients and candidates. Please read them carefully before engaging our services.

Section 01

In these Terms and Conditions, the following definitions apply: "Swift" / "We" / "Us" means Swift Recruitment Agency UK, including its technology division Swift Talent Partners "Client" means any company or individual that engages Swift to source candidates for employment "Candidate" means any individual who registers with Swift or is presented to a client for a role "Placement" means a successful engagement where a candidate introduced by Swift commences employment with a client "Introduction" means the provision of a candidate's CV, details or profile to a client "Fee" means the recruitment fee payable by the client upon a successful placement "Engagement" means any form of employment, contract, consultancy or working arrangement between a client and a candidate introduced by Swift.

By engaging our services, both clients and candidates agree to these Terms and Conditions in full.

Section 03

3.1 Engaging Swift By requesting candidates from Swift, or by accepting an introduction of a candidate, the client agrees to be bound by these Terms and Conditions. 3.2 Accuracy of Information The client must provide accurate and complete information about the role, company, salary, location and requirements. Swift accepts no liability for placements that fail due to inaccurate information provided by the client. 3.3 Exclusivity Swift does not require exclusivity on roles. However, if a candidate is introduced by Swift and subsequently placed by the client through any means — including direct contact, another agency, or the client's own processes — the full placement fee remains payable to Swift. 3.4 Notification of Engagement The client must notify Swift immediately upon making an offer to any candidate introduced by Swift, and upon that candidate commencing employment or any form of engagement. 3.5 Re-engagement If a client engages a candidate introduced by Swift within 12 months of the original introduction — in any capacity — the full placement fee is payable even if the original placement did not proceed. Important: A candidate introduced by Swift remains our introduction for 12 months from the date of introduction, regardless of whether a placement was made.

Payment terms are 14 days from the date of invoice unless otherwise agreed in writing. 4.5 Late Payment Swift reserves the right to charge interest on overdue invoices at a rate of 8% per annum above the Bank of England base rate in accordance with the Late Payment of Commercial Debts (Interest) Act 1998. 4.6 Salary Definition For the purpose of fee calculation, salary means the candidate's total basic annual salary, excluding bonuses, benefits, pension contributions and other non-cash benefits, unless otherwise agreed in writing.

Swift offers a 3-month free replacement guarantee on all permanent placements, subject to the following conditions: The placement fee has been paid in full within the agreed payment terms The candidate leaves or is dismissed within 3 months of their start date The departure was not caused by significant changes to the role, salary, location or reporting structure made by the client after the offer was accepted The client notifies Swift within 7 days of the candidate's departure The client engages Swift to find a replacement within 30 days of notification The replacement guarantee provides one free replacement search. If no suitable replacement is found after a reasonable search, a partial refund may be negotiated at Swift's discretion. The replacement guarantee is a service commitment, not a cash refund. It entitles the client to one free replacement search for the same or equivalent role.

Any misrepresentation may result in removal from our database and notification to the relevant employer. 6.2 Right to Work Candidates must have the legal right to work in the United Kingdom and must provide evidence of this when requested. Swift accepts no liability for placements that fail or are terminated due to right to work issues. 6.3 Consent to Introduction By registering with Swift, candidates consent to their details being shared with potential employers for the purpose of finding suitable employment. Swift will always discuss a role with a candidate before making an introduction. 6.4 Exclusivity Candidates are free to register with multiple agencies. However, candidates must inform Swift if they are already registered with another agency for a specific role to avoid duplicate submissions. 6.5 Fees Swift's services are completely free for candidates. We are paid by the employer upon a successful placement. We will never charge candidates any fees for our services. 6.6 Communication By registering with Swift, candidates agree to be contacted by telephone, email and other means regarding suitable opportunities. Candidates can opt out of communications at any time by contacting recruitment@swiftra.uk.

Candidates can opt out of communications at any time by contacting recruitment@swiftra.uk.
